HAYWARD, Calif. (CN) – Bay Area Rapid Transit police officers Tasered and crushed a man to death though they knew he was injured, his son claims in court.
Joseph James Greer sued the City of Hayward and BART in Alameda County Court for the wrongful death and assault and battery of his father, James Greer.

In his March 23 lawsuit, Greer claims that BART officers pulled over his father at a sobriety checkpoint and asked him to get out of the car on May 23, 2014.
He says his father complied, and told the officers that he was healing from gunshot wound and had a protruding hernia in his stomach.
Officers demanded that he lie down on his stomach anyway, and when he couldn’t do it, they forced him to the ground, face-down, then Tasered his three times, his son says.
Five officers then sat on him – one on each arm and leg and one on his back, his son says.
His father died from the “excessive and unbearable weight of the officers” and from “multiple Tasings,” Joseph Greer says.
He seeks punitive damages for constitutional violations, assault and battery, wrongful death and negligence.
BART officials could not be reached for comment over the weekend.
