Colorado Springs Police Department: 719 444-7000My brother and I were pulled over for no apparent reason. The officer failed to identify the reason for the stop. Officer David Nelson pulled out and armed his taser and forced my brother out of the vehicle. As you can see from the video the officer never identified himself nor the reason for the stop. Now in the police report he totally lied about his accounts of the event. Trying to establish probable cause he claims he spotted my vehicle earlier in the day and that he noticed the dark tinted windows. He claims he tried to pull the vehicle over but the vehicle fled the scene and due to high traffic he couldn’t give chase. No if that was the case how come we were never charged with running from a officer? That’s a felony if I’m not mistaken.
This is why you should ALWAYS FILM THE POLICE as soon as you have an interaction. It seems that Ryan was upset because the cops were on what I call a “fishing expedition.” This is when police officers pull over cars for nothing more than they believe they’ll be able to find something to charge them with. Had Ryan been recording from the start the officer MIGHT have thought twice about using this tactic. Or even if he decided to press on Ryan would have had the video of it.
Sadly, Ryan didn’t start recording until the officer was already arresting his brother and another cop had a taser pointed at him. This leaves the window open for the police to use a number of lies to justify their actions on camera after the start of the stop. Even from what I saw Ryan didn’t deserve the treatment he was getting. As a passenger of a vehicle you are not the suspect of any traffic crime. You are merely a passenger and technically Ryan could have merely walked away. I doubt that would have worked out for him in this case but maybe if the video was going early and Ryan had asked, “Am I being detained or am I free to go?”
